1949 Railway Express Agency, Inc. v. Kessler, 189 Va. 301, 52 S.E.2d 102.Loss of goods allegedly due to mis-delivery by express company. In transporting goods, express company is common carrier and is insurer of goods it transports with some exceptions for happenings beyond its control. Duty is not terminated ordinarily, until delivery of goods, within and at reasonable time, to right person, at proper place, and in proper manner. Discussion of rights of express company as to goods not able to be delivered to consignee.
